Private copying

The historic mission of PROCIREP is to manage the share of remuneration for audiovisual private copying that, under the law, belongs to cinema and television producers.

This remuneration is collected on recording media used for copying protected works for personal use: smartphones, tablets, external hard drives, TV programme recorders (hard-disk decoder recorders or, more recently, remote storage services known as "nPVR"), USB sticks, recordable DVDs …

75 % of the sums collected are distributed among the rightsholders of French and European works broadcast on the main national channels, based on the copies made by individuals. The remaining 25 % are allocated, as required by law, to creation support actions - for the development and production of cinematic and television works, or of collective interest - by the Cinema and Television Commissions of PROCIREP.

Distribution rules and rates are set by PROCIREP’s Executive Committee, after consulting the Producers’ College, a technical committee bringing together representatives of all the rightsholders in the “producers” share: producers’ trade organisations, broadcasters, the INA, music-video producers (represented by the SCPP and SPPF) and the ARP.

The tariffs applicable to each type of media are set by an independent commission provided for by the French Intellectual Property Code (art. L. 311-5), the Private Copying Commission: chaired by a State representative, it brings together, in equal numbers, the remuneration’s beneficiaries (authors, performers, producers) and those liable to pay it (equipment manufacturers and importers, consumers).

Private copying in Europe

PROCIREP is a founding member of EUROCOPYA, the European association of collective management organisations for audiovisual producers’ private-copying rights, which represents producers’ interests before the European institutions.

EUROCOPYA brings together thirteen statutory member collecting societies - in France, Germany, Italy, Spain, Portugal, Belgium, the Netherlands, Austria, Switzerland, Denmark, Sweden, Slovakia and Poland - and facilitates the conclusion of bilateral reciprocity agreements, which enable the cost-effective repatriation of private copying revenues generated by the distribution of catalogues outside their national territory.

For French producers, the main collection territories are Germany, Belgium and Switzerland, as well as Italy since the reciprocity agreement concluded with ANICA Servizi for cinematographic works.

Retransmission rights

ANGOA (National Agency for the Management of Audiovisual Works) is the collective management organisation (CMO) for the rights of French producers regarding the full and simultaneous retransmission of television programmes by third-party operators: cable, satellite, ADSL and fibre, mobile telephony, OTT…

Established by French producers in 1981 – at the same time as AGICOA, its international counterpart based in Geneva – following European case law that recognised producers' right to supplementary remuneration in the event of cable retransmission of their programmes, ANGOA is approved by the Ministry of Culture to collect and distribute these rights, whose collective management was made mandatory by the EU "Cab-Sat" Directive of 1993. The "Cab-Sat 2" Directive of 2019 subsequently extended this collective management to retransmission methods other than cable (which had already been subject to voluntary collective management within ANGOA since 1997).

Chaired by Isabelle MADELAINE since 2024, ANGOA now brings together more than 700 French production companies, distributors and rightsholders, all professional organisations of film and audiovisual producers, as well as foreign rightsholders – including US studios – through the cooperation agreement concluded with AGICOA.

Since 1994, PROCIREP’s teams have handled the day-to-day management of all of ANGOA’s activities.

ISAN: registering works

ISAN (International Standard Audiovisual Number) is the ISO standard for the unique and permanent identification of audiovisual works – films, television programmes, and, more broadly, any work, including interactive works, comprising moving images – as well as their various versions. This registration number meets the technical and economic requirements for the distribution of works in the digital environment.

To implement the standard in France, PROCIREP and ANGOA founded the "Agence Française ISAN" association in 2004, together with ARP, SACD and SCAM – joined in 2016 by INA – for which PROCIREP has been responsible for operational management since 2005. By the end of 2025, the French catalogue comprises over 500,000 works registered by more than 12,000 declarants.

The ISAN identifier is required for rights declarations submitted to PROCIREP (private copying) and ANGOA (broadcasting rights), as well as for projects supported by their creation support. It has also been mandatory since 2017 for works and work projects supported by the CNC (Centre National du Cinéma et de l'image animée).

Other rights & activities

In accordance with its corporate purpose - to represent and defend the interests of film and audiovisual producers in the field of copyright and related rights - PROCIREP carries out several other functions:

• The administrative management of AMAPA, the mediation association for audiovisual authors and producers
• Taking part in the work of the CSPLA (the French High Council for Literary and Artistic Property)
• Monitoring, in consultation with producers' professional organisations, of copyright matters in the digital environment in France and Europe, particularly recently on AI-related topics.

Educational use of works

Mandated by all rightsholders in the film and audiovisual sectors, PROCIREP has concluded agreements with the Ministry of National Education governing the use of film and audiovisual works for teaching and research purposes (the 2006 and 2009 agreements, renewed for three-year periods). These agreements ensure lawful access to works for teachers and researchers – excluding any recreational use – and are accompanied by joint awareness-raising initiatives on intellectual property.

PROCIREP also passes on to French producers and rightsholders the educational-use royalties provided for by Swiss law, under the reciprocity agreement concluded with SUISSIMAGE.

Culture through private copying

The association “La Culture avec la Copie Privée” works to raise public awareness of the private-copying mechanism and of the various creation-support schemes it funds.

It serves, in particular, as the managing operator on behalf of the collective for the public platform on creation support from the various French Collective Management Organisations, including PROCIREP and ANGOA: aidescreation.org, where any interested party can find details of the various creation support awards granted in previous years.
